Van İl Seçim Kurulu, Büyükşehir Belediye Başkanı adayı DEM Partili Abdullah Zeydan'ın "memnu hakkının iadesi kararının" Adalet Bakanlığı tarafından mesai bitimine 5 dakika kala yapılan itiraz üzerine geri alındığını duyurdu.
Abdullah Zeydan'ın seçimde aday olmasında Van İl Seçim Kurulu bir sakınca görmemişti.
Bizim seçim hukukumuzda bir vatandaşın aday olabilmesi için vermesi gereken belgelerden biri "adli sicil ve arşiv kaydı belgesi".
İl Seçim Kurulu, adaylar hakkında "seçilme yeterliliği yönünden" inceleme yapar ve bir eksiklik ya da aday olma şartları ile ilgili yetersizlik varsa söz konusu vatandaş aday olamaz.
Abdullah Zeydan aday olup, adı listeye yazıldığına göre bu incelemeleri geçmiş olması lazım.
Zeydan hakkında kesinleşmemiş bir karar gerekçe gösteriliyor ve 130 bin oy az alan AKP adayı seçilmiş sayılıyor.
Ceza hukukunun en önemli kurallarından biri hakkında kesinleşmiş bir mahkeme kararı olmayan herkesin suçsuz olduğu ilkesi.
Belli ki işini bilen İl Seçim Kurulu, Adalet Bakanlığı ile el ele vererek Zeydan'a pusu kurmuş.
Kurulan pusu esasen seçmenin iradesine yönelik.
Bu da tıpkı kayyım uygulaması gibi seçmen iradesine karşı bir darbe anlamına gelir.
Geçtiğimiz yerel seçimde de bu tür uygulamalar olmuştu belli ki bu uygulamaların tadı Erdoğan rejiminin damağında kalmış!
Seçimi kazanamayınca, rakip adayın seçilme hakkını yok say, olmadı kayyım gönder!
