Şunu ifade edeyim ki, Sinan Ateş Davasında adalet yerini bulmazsa, isminde “adalet” olan iktidar partisi adalet sahasında itibarını sıfırlayacağı gibi toplumda devlete saygı da büyük kayba uğrayacak. Hatta “eninde sonunda yıkılıp gitmeye mahkum olacak.”
Bu hüküm cümlesini Cumhurbaşkanı Erdoğan’ın açıklamalarını referans alarak yazdım. Elbette ki adaletin olmadığı devletlerin yıkıldığı tarihi bir gerçek ve devletimizin başı olan Cumhurbaşkanı Erdoğan da bu tarihi gerçeği her fırsatta dile getiriyor “Devletin adalet dağıttığı ölçüde güçlü olduğunu, adaletin olmadığı yerde huzurun refahın olmayacağını, adaletin olmadığı bir devletin eninde sonunda yıkılıp gitmeye mahkum olduğunu” söylüyordu.
Erdoğan yargıçlara yaptığı konuşmalarda “Bir ülkede halkın bunalmış ellerini semaya açarak adalet çığlığı atar hale gelmişse oradaki yargı sistemin sorunlu” olduğunun altını kalın kalın çiziyordu…
Ankara 32. Ağır Ceza Mahkemesi’nde terazi kuruldu, iktidar teraziye çıktı bu sözlerinin sınavında ve bu imtihanın bütünlemesi de yok.
Sinan Ateş davası 22 yıldır ülkeyi aralıksız yöneten AK Parti iktidarının “sırat-ı müstakim” sınavıdır. En büyük adalet sınavıdır. Ve iktidar ya bu sınavı geçecek ya da geçemeyecek.

Eski Ülkü Ocakları Genel Başkanı Sinan Ateş’in Ankara’nın göbeğinde öldürülmesine ilişkin 22 sanıklı davanın dünkü duruşmasında müşteki sıfatıyla konuşan Ayşe Ateş, Sinan Ateş’in öldürülmesi talimatını verdiklerini söylediği isimleri de açıkladı.
Merhum Sinan Ateş’in öldürülmeden önce kendisine “Ayşe, İzzet Ulvi Yönter ve Semih Yalçın, Ahmet Yiğit Yıldırım ile Olcay Kılavuz’a talimat vermiş ve beni öldürmek için kapı kapı gezip kiralık katil arıyorlarmış” dediğini aktardı.
Ve devamında mahkemeye söylediği bilgilerin ifadesine eklenmesini isteyen Ayşe Ateş şöyle dedi:
“Söylediğim ekstra bilgilerin ifademe eklenmesini istiyorum. Ayrılan 17 kişilik dosyanın dosyamızla birleştirilmesini istiyorum. İsmini verdiğim kişilerin sorgulanmasını ve dosyaya dahil edilmesini, eksik ifadelerin hızlı bir şekilde dosyaya ekletilmesini istiyorum.”
Bu sözleri duyan mahkeme heyeti ne yapacak?
İlk duruşmada yaptığı gibi “bu iddianamede yazmıyor” diyerek üstünü kapatacak mı? Bunlar sadece iddia, Sinan Ateş hayatta değil, size böyle söylediğini biz nereden bilelim, ses kaydınız, kanıtınız nerede mi diyecek?
Ayşe Ateş’in verdiği bu bilgilere rağmen “ama 17 kişi dosyadan ayrı, bu isimlerin bu dosyayla ilgisi yok” mu diyecek?!
Bütün bu bilgiler ortadayken hakim, yargılamayı iddianameyle sınırlı mı tutacak? Yoksa her şeye rağmen, soruşturmayı genişletme kararı vererek iddianamedeki Sinan Ateş’in öldürülmesinin ipuçlarının üzerine mi gidecek?
Ne olacak?
Ayşe Ateş’in verdiği bu bilgilerden sonra sanıkların mahkeme salonunu tiyatroya çevirmeye çalışmalarına göz yummaya devam mı edilecek?
